    TERMS AND CONDITIONS OF ATTENDANCE AND PARTICIPATION

    These are the terms (the “Agreement”) that govern your attendance at and/or participation at CyberMarketingCon 2024 (the “Event”). Subject to the terms and conditions herein, the Event is scheduled to take place from December 8, 2024 to December 11, 2024, at the Loews Philadelphia Hotel, 1200 Market St, Philadelphia, PA 19107.

    By registering for the Event, you are agreeing to these terms, which form a legal binding contract between Cybersecurity Marketing Society LLC (“CMS”, “we”, “us”, “our”, the “Organizer”), and the registered attendee and/or participant and/or user (“you”, “your”, “yourself”).

    Registration for this event is strictly personal and must be completed by you. By registering for the Event, you acknowledge and affirm that: (i) you are registering for yourself and not on behalf of another individual; (ii) you acknowledge, understand and accept these terms and conditions as they apply directly to your attendance at the Event; (iii) no third-party registrations are permitted, and that you have registered for yourself; (iv) you will pay the total fee identified in the ticketing portal (“Event Fee”) at the time of your registration; and (v) you hereby waive any applicable rights to require an original (non-electronic) signature or delivery or retention of non-electronic records, to the extent not prohibited under applicable law (collectively, “Event Registration”).

    Please fully and carefully read these terms and conditions.

    1. EVENT ADMISSION

    1.1 Admittance. Your registration for the Event confers upon you the right to entry to the Event only. All additional costs related to your participation in the Event, including but not limited to travel, food, and accommodation expenses, are your exclusive responsibility. We shall bear no liability or obligation with respect to any such expenses incurred by you.

    1.2 Termination. We are dedicated to ensuring a harassment-free environment for all participants at the Event. It is expected that every attendee will conduct themselves with decorum, exhibiting respect and dignity towards others present at the Event. You hereby acknowledge and agree that we reserve the unilateral right to remove you from the Event premises if, at our sole discretion, your behavior is deemed disruptive or detrimental to the conduct of the Event, or it impairs the enjoyment or safety of other attendees or speakers. This determination is within our exclusive judgment and authority.

    1.3 Media Rights. We reserve the exclusive right to use any photographs and recordings taken of you at the Event for promotional purposes and for the publication of replay videos of Event sessions, including but not limited to use on social media, websites, and in marketing materials.

    1.4 Photography and Recording Policy. You are permitted to take photographs and record short video clips at the Event, which may be utilized for your personal social media or blogging reasons. However, without explicit written consent from us, any published audio and/or video clips must be non-continuous, not exceeding thirty (30) seconds in length. Additionally, photographs should not include proprietary Event content or materials. Notwithstanding the above, the recording of full sessions, whether audio or video, is expressly prohibited.

    1.5 Event Agenda. We endeavor to adhere to the advertised schedule; however, circumstances may require adjustments. By registering for the Event, attendees acknowledge and consent that the organizers reserve the sole and absolute discretion to modify any elements of the Event. This includes, but is not limited to, changes in the Event's name, themes, content, agenda, speakers, performers, hosts, moderators, venue, and timing. Such modifications may be made without prior notice, and attendees shall have no claim against the organizers in respect of any such alterations.

    1.6. Account. In order to use some of the platforms including, but not limited to Organizer Website, Event App and/or Event Community (“Service”) features you may have to create or use an account (an “Account”). If you create an Account, you must provide accurate and complete information for yourself as specified. You as a user are solely responsible for the activity that occurs in your Account, and you must keep your Account password secure. You must notify us immediately of any unauthorized use of your Account. You acknowledge and agree that information you provide for the purpose of creating an Account, joining an event community or registering for an event or use of the Service, including but not limited to, name, email address, phone number may be provided to and maintained by the Organizer, whether or not you complete the registration process, and may be used by the Organizer in connection with the event or future events or other products and Services. Please refer to our Privacy Policy to understand more about data collection, usage and further data protection measures followed by us.

    1.7 Sending/Receiving Messages. The Service may permit you to send messages (including via email) to a Third Party Source or to other users (“Messages”). You are solely responsible for the messages you send and the consequences of sending them, and you agree to hold us harmless, and expressly release us, from any and all liability arising from your Messages. You grant us a worldwide license to use, store, and reproduce your Messages for the limited purpose of facilitating sending them to your designated recipients (and we may also use the tools, Services of third party Service providers to facilitate the sending of Messages to your designated recipients). You guarantee that you own or have the necessary rights and permissions to use all of the Intellectual Property Rights in and to your Messages, and to grant the foregoing license to us. You retain all of your ownership rights in your Messages. You acknowledge and agree that the provisions of Section 1.8 (User Submissions) below shall also apply to Messages that you send via the Service.

    1.8 User Submissions. Attendees and users may create, post, share or store content, messages, materials, data, information, text, graphics, audio, video, or other items or materials on our platforms including, but not limited to Organizer Website, Event App and/or Event Community ("User Submissions"). You are solely responsible for your use of the platform(s) and use them at your own risk. By using the platform, you agree not to post, upload to, transmit, distribute, store, create or otherwise publish through the Site and the App any of the following:

    User Submission

    a.     that is unlawful, libellous, defamatory, obscene, pornographic, indecent, lewd, suggestive, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory, fraudulent, deceptive or misleading;

    b.     That would constitute, encourage or provide instructions for a criminal offense, violate the rights of any party, or that would otherwise create liability or violate any local, state, national or international law.

    c.     That may infringe any patent, trademark, and trade secret, copyright or other intellectual or proprietary right of any party.

    d.     that impersonates any person or entity or otherwise misrepresents your affiliation with a person or entity;

    e.     that, our sole judgement, is objectionable or which restricts or inhibits any other person from using the platform, or which may expose us or the users to any harm or liability of any type;

    f.      which violates the terms of our guidelines, principles ,policies or rules posted on the Site and the App or as and where communicated to you;

    g.     Unsolicited promotions, spam’, , advertising or solicitations;

    h.     Private information of any third party, including, without limitation, addresses, phone numbers, email addresses or any other such personal details; and Viruses, corrupted data or other harmful, disruptive or destructive files;

    You shall be solely responsible for your User Submissions and the consequences of posting or publishing them. We have complete right in terms of decision making as to whether or not to publish your User Submissions and we reserve the right without further notice to you, to monitor, censor, edit, remove, delete and/or remove any and all User Submissions at any time and for any reason.

    You further guarantee that you own or have the necessary rights and permissions to use and authorize us to use all Intellectual Property Rights in and to your User Submissions, and to enable inclusion and use thereof as contemplated by this Agreement. You retain all of your ownership rights in your User Submissions. Any copyrighted or other proprietary content distributed with the consent of the owner must contain the appropriate copyright or other proprietary rights notice. The unauthorized submission or distribution of copyrighted or other proprietary content is illegal and could subject the user to personal liability or criminal prosecution.

    Subject to this Agreement and the terms of our Privacy Policy, by submitting the User Submissions, you hereby grant us a worldwide, irrevocable, non-exclusive, royalty-free, perpetual license to use, reproduce, distribute, prepare derivative works of, display and perform the User Submissions only in connection with the Service, including without limitation for redistributing part or all of your User Submissions (and derivative works thereof), and you hereby waive any moral rights in your User Submissions, to the extent permitted by law.

    You understand and acknowledge that when accessing and using the Service: (i) you will be exposed to User Submissions from a variety of sources, and that we are not responsible for the accuracy, usefulness, safety or Intellectual Property Rights of, or relating to, such User Submissions; and (ii) you may be exposed to User Submissions that are inaccurate, offensive, indecent, or objectionable. You agree to waive, and hereby do waive, any legal or equitable rights or remedies you may have against us with respect to (i) and (ii) herein

     

    2. FEE(S)

    2.1 Payment Terms. The full payment of the Event Fee is required at the time of Event Registration. In the event that the payment is insufficient or declined for any reason, the organizers reserve the right to deny admission to the Event. Under such circumstances, the organizers shall bear no liability for any inconvenience or loss incurred as a result of this denial.

    2.2 Taxation. The Event Fee is exclusive of all applicable taxes, including but not limited to sales tax, value-added tax (VAT), and other governmental charges and duties. Where relevant, such taxes will be added to the Event Fee and billed to the attendee. It is the responsibility of the attendee to pay all such additional charges.

    3. CANCELLATION POLICY

    If you cancel your Event Registration by September 1st, 2024, you will receive an eighty percent (80%) refund of the Event Fee (the “Refund”). If you cancel your Event Registration following September 1st, 2024, you will not receive any refunds on the Event Fee. For the sake of clarity, and in order to qualify for the Refund, you must provide us with your written notice of cancellation by emailing us at conference@cybersecuritymarketingsociety.com. 

    4. PRIVACY POLICY

    Data Collection and Usage Acknowledgement: Kindly refer to the Privacy Policy for further understanding of how we collect, store, protect and process the data collected through our services. By providing us with information (including without limitation, personal details such as name, email address, and phone number) for the purposes of Event Registration, you acknowledge and consent that this information may be collected, stored, and maintained by us, irrespective of whether you complete Event Registration. Furthermore, you agree that we may utilize this information in relation to the Event and any of our future events, or any other product or service offered by us.

    Please also be aware that certain personal information and other information provided by you in connection with your use of the Service may be stored on your Device (even if we do not collect that information). You are solely responsible for maintaining the security of your Device from unauthorized access.

     

    5. INTELLECTUAL PROPERTY

    5.1 CMS Intellectual Property Rights and Usage Restrictions. All intellectual property rights related to the Event, including without limitation, Event content, trademarks, trade names, designs, texts, graphics, pictures, information, data, audio-visual files, sound files, tools, widgets, applications, software, and any files in whatsoever format, whether used collectively or individually, are the proprietary property of CMS; furthermore, any content and materials distributed in connection with the Event are solely owned by CMS. You are not permitted to use, reproduce, or allow others to use or reproduce these intellectual properties without our prior express written consent. This prohibition includes the distribution of any Event-related content. No rights or licenses to any intellectual property owned by or licensed to CMS are granted under this Agreement, and all such intellectual property rights remain the sole and exclusive property of CMS.

    5.2 Intellectual Property of Third Parties. All trademarks, registered trademarks, product names, company names, and logos that are not owned by CMS and appear in connection with the Event are the property of their respective owners. The mention of or reference to any products, services, processes, or other information by trade name, trademark, manufacturer, supplier, or otherwise within the context of the Event does not imply or constitute an endorsement, sponsorship, or recommendation by CMS.

    6. WARRANTIES AND LIMITATION OF LIABILITY

    CMS DOES NOT MAKE ANY WARRANTY OR GUARANTEE THAT ATTENDANCE AT THE EVENT WILL LEAD TO SPECIFIC RESULTS OR OUTCOMES. THE APPLICATION AND EFFECTIVENESS OF PRINCIPLES AND TACTICS PRESENTED DURING THE EVENT VARY BY INDIVIDUAL, AND AS SUCH, OUTCOMES SUCH AS ENHANCED PRODUCTIVITY OR IMPROVED WORK-LIFE BALANCE CANNOT BE GUARANTEED. INDIVIDUAL EXPERIENCES MAY DIFFER. CMS EXPLICITLY DISCLAIMS ALL WARRANTIES TO THE MAXIMUM EXTENT ALLOWED UNDER APPLICABLE LAW, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TIMELINESS, AND MERCHANTABILITY IN CONNECTION WITH THE EVENT AND ANY RELATED MATERIALS PROVIDED. CMS ASSUMES NO RESPONSIBILITY OR LIABILITY FOR THE RELIANCE BY ANY ATTENDEE ON THE CONTENT PRESENTED AT THE EVENT OR FOR ANY INFORMATION PROVIDED DURING THE EVENT. ATTENDEES ARE ADVISED THAT THE APPLICATION OF INFORMATION AND CONTENT FROM THE EVENT IS AT THEIR OWN DISCRETION AND RISK. EXCEPT AS REQUIRED BY LAW, CMS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL COSTS, DAMAGES, OR LOSSES ARISING FROM OR RELATED TO THE EVENT OR THIS AGREEMENT. THIS INCLUDES, BUT IS NOT LIMITED TO, ANY CLAIMS IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE. THE MAXIMUM AGGREGATE LIABILITY OF CMS FOR ANY CLAIMS IN ANY WAY CONNECTED WITH THE EVENT OR THIS AGREEMENT, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, IS LIMITED TO THE EVENT FEE.

    7. PHOTO RELEASE

    Media Consent and Release for Event Attendees. By participating in the Event, you unequivocally grant us, and any of our authorized representatives, the perpetual, worldwide, royalty-free right and license to record, photograph, videotape, and capture your likeness and voice in any and all forms of media, now known or hereafter devised. This includes, but is not limited to, digital media (such as websites, social media, and online publications), print media (including newspapers, magazines, brochures, and posters), broadcast media (like television, radio, and podcasts), and any other form of media or technology, both existing and subsequently developed. You agree that these recordings, photographs, and captures can be used, reproduced, altered, published, broadcast, and distributed by us for any purpose, including but not limited to marketing, publicity, advertising, and promotional activities, without further approval or compensation. This consent extends to the use of your name, image, likenesses, voice, and biographical materials for these purposes. You waive any right to inspect or approve the finished product or the use to which it may be applied, including any written copy that may be created in connection therewith. You also release and hold harmless CMS from any claims, damages, or liability arising from or related to the use of the media as described above.

    8. GOVERNING LAW AND JURISDICTION

    This Agreement shall be governed by the laws of the State of Delaware, without regard to conflict of law principles, and the parties shall submit to the exclusive jurisdiction of the Delaware courts.
